1. Scope of application

These General Terms and Conditions (hereinafter "GTC") apply to all legal relationships of Pavone for the purchase of goods via the webshop at the URL www.pavone-zurich.com (hereinafter "Webshop"). Pavone provides its services exclusively on the basis of these GTC. Deviating terms and conditions of the Customer as well as amendments and supplements to these GTC are only valid if they have been accepted by Pavone in writing. In such cases, these GTC shall apply in addition.

 

  1. Assortment

The current Pavone range can be found in the webshop . This information as a whole has a descriptive character. The offer contained therein is made without obligation. The range and offer can be adapted by Pavone at any time. The information in the web shop (e.g. product descriptions, illustrations, sizes and other information) does not represent any assurance of properties or guarantees, unless explicitly stated otherwise.

The colour values are displayed in the webshop as true to the original as possible. The original goods may contain deviations from the colour values in the webshop.

 

  1. Prices

The prices/currency stated at the time of ordering the goods shall be decisive. All prices for the goods stated in these GTC, in the offer, in the order confirmation and in the contract are understood as prices including the statutory VAT rate.

 

  1. Registration/Data protection

In order to complete an order process, the Customer must register on the Pavone website with his/her personal details. In doing so, the customer undertakes to use truthful information. Pavone reserves the right to delete a customer account at any time without giving reasons.

Pavone attaches great importance to the protection of your data. For details, please refer to the separate data protection regulations.

 

  1. Binding nature of the order

The offer on the webshop is deemed to be an invitation to submit an offer. As soon as the Customer's order is received by Pavone, this shall be deemed to be an offer. The contract is concluded with the order confirmation by Pavone. The order confirmation is sent by e-mail. If Pavone does not confirm the order within 5 days, the Customer shall no longer be bound by its offer.

 

Notwithstanding the foregoing, a contract shall be concluded:

Die Zahlung erfolgt wahlweise per Rechnung, Vorauszahlung, PayPal oder Kreditkarte.

 

6.1 Payment variants
You can also conveniently pay for your order by invoice after receipt of the goods. You will receive the invoice separately by post or email, which must be paid within 14 days of the invoice date (expiry date).

In the case of purchase on account, the processing shall be carried out via the service provider MF Group Factoring AG and its General Terms and Conditions shall also apply, which in particular also provide for the possibility of a credit check. Pavone reserves the right to exclude payment by invoice at its own discretion and without giving reasons.

In the following cases, purchase on account is not possible in any case:

 

 

6.2 Payment in advance

In the case of advance payment, delivery will only be made after receipt of payment.

 

6.3 Payment by credit card

You can also pay conveniently and securely by credit card. We accept the credit cards listed in the webshop. If you return ordered goods, the amount will be credited back to your credit card account. Your credit card details are transmitted in encrypted form. This high security standard means that shopping at Pavone by credit card is safe.

 

  1. Delivery times/delivery costs

 

7.1 Delivery times:

Pavone offers the products within the scope of availability. Should a product not be available or no longer available, the customer will be informed accordingly in an appropriate form as soon as possible. Pavone reserves the right to withdraw from the contract if products are no longer available through no fault of Pavone AG. Delivery will be made within 2-5 working days. Before public holidays (Easter, Christmas), longer parcel delivery times must be expected. Pavone will point this out when the order is placed.

 

In the event of temporary obstacles to delivery for which Pavone is not responsible ("force majeure", in particular war and warlike conditions, strike, sabotage, epidemics and pandemics, untimely self-supply), Pavone shall be released from its obligation to perform for the duration of the existence of the obstacle. In these cases, the Customer's obligation to provide the counter-performance also lapses. Payments already made will be refunded immediately. If Pavone is unable to deliver within four weeks, the Customer is entitled to withdraw from the contract. Further legal claims of the customer remain unaffected.

Pavone is entitled to make partial deliveries insofar as this is reasonable for the Customer. In the event of partial deliveries, Pavone shall bear the additional packaging and shipping costs incurred.

 

7.2 Delivery costs

The packaging and shipping costs are displayed in detail before the order is completed and shown separately on the invoice / order confirmation.

Pavone shall not be liable in the event of undeliverability or delayed delivery of the goods as a result of incorrect information on the delivery address by the Customer or the absence of the recipient.

 

  1. Due date

The customer is obliged to pay the purchase price within 14 days of the invoice date (expiry date).

After expiry of this period, the Customer shall be in default without the need for a reminder. Reminders sent by Pavone during the period of default shall be subject to reminder fees in the amount of the actual expense.

The delivered goods remain the property of Pavone until the purchase price has been paid in full.

 

  1. Intellectual property

All rights to the website, the webshop and their content, products, logos, etc. are either the property of Pavone or have been licensed to Pavone by third parties. Pavone or Pavone's licensors are exclusively entitled to any existing intellectual property rights such as copyrights, trademark rights and other intellectual property rights. This content may only be used by the Customer in connection with the use of the website or webshop and may not otherwise be downloaded, copied, reproduced, distributed, transmitted, broadcast, performed, licensed or used for any other purpose without the prior written consent of Pavone.

 

  1. Final provisions

Swiss substantive law shall apply to the contractual relationship with the customer. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.

Irrespective of this choice of law, consumers who have their permanent place of residence in a member state of the European Union at the time of conclusion of the contract may also invoke mandatory consumer protection provisions of their country of residence.

If the customer is a merchant, the exclusive place of jurisdiction for all disputes arising from this contract is Zurich, Switzerland.
